Applicable Terms and Conditions
  Preliminary
  • This Buyback Offer ("Offer") is provided and administered by Reliance Retail Limited only.
  • By participating in this Offer, Eligible Customer agrees to be bound by:
    • these terms and conditions ("T&C");
    • the Offer Benefits and other relevant documentation including any modifications, alterations or updates thereof, that are published in the MyJio App.
  • Definitions
    • “RRL” shall mean Reliance Retail Limited.
    • “RJIO” shall mean Reliance Jio Infocomm Limited.
    • “RRL Store” shall mean and include all types and formats of stores, digital as well as online, of RRL, including Reliance Digital.
    • “Reliance Digital” shall mean retail outlets of RRL, called as Reliance Digital, Reliance DX Mini.
    • “Amazon” shall mean and include amazon.in and the mobile application/ website thereof managed and operated by Amazon Seller Services Private Limited.
    • “Offer” shall mean the Buyback Offer made available by RRL.
    • “Buyback Value” shall mean 70% of the invoice value (excluding taxes) of the Eligible Product.
    • “Eligible Product” shall mean selected models of the Apple India Private Limited (“Apple”) brand being the following mobile devices:- (a) iPhone 8, (b) iPhone 8 Plus and (c) iPhone X, which is purchased by a Purchaser during Offer Period from an RRL Store, or from Jio.com, MyJio or Amazon where RRL is the seller.
    • “Eligible Customer” shall mean a person (i) who is the Purchaser of the Eligible Product, and (ii) who is an active subscriber of the RJIO connection (existing or new) on the date of opting Offer, and (iii) who continues to be an active subscriber of RJIO connection, on the date of Redemption, by performing either Eligible Recharge or Eligible Tariff Plan for at least a period of 12 consecutive months (for avoidance of doubt, eligible customer using pre-paid connections need to keep his account recharged for 12 months, which may cover more than 12 Eligible Recharges and post-paid customer should continue for at least 12 consecutive monthly billing cycle), or by performing One Time Yearly Recharge, and (iv) who enrolls for the Buyback Offer on MyJio App and (v) is free from any lien or charge whatsoever from any third party.
    • “Purchaser” shall mean any one who purchases one or more units of the Eligible Product.
    • “Redemption” shall mean buyback of the Eligible Product by RRL, during Redemption Period pursuant to T&C of this Offer.
    • “Redemption Period” shall mean the period between October 01st, 2018 and up to December 31st, 2018 (both days included).
    • “Offer Period” shall mean (i) as regards iPhone 8 and iPhone 8 Plus, the period starting from September 29th, 2017 and up to December 31st, 2017 (both days included), and (ii) as regards iPhone X,  the period starting from November 03rd, 2017 and up to December 31st, 2017 (both days included).
    • “Eligible Recharge” shall mean a pre-paid recharge of RJIO’s telecom services for Rs. 799 plus taxes if applicable.
    • “Eligible Tariff Plan” shall mean the post-paid tariff plan of RJIO’s telecom services for Rs. 799 or above, plus taxes as applicable.
    • “One Time Yearly Recharge” shall mean a pre-paid recharge of RJIO telecom services for Rs. 9,999 plus taxes if applicable.
    • “T&C” shall mean the applicable terms and conditions of the Offer.
    • “Offer Benefits” shall mean the benefits accruing to the Eligible Customer under the Offer as shown herein-below.
  • The Offer and the benefits thereunder shall be made available by RRL only to Eligible Customers.

  • Benefits of the Offer (“Offer Benefits”)
    • A Purchaser may purchase the Eligible Product. The Eligible Product is only for the personal use of the Purchaser and the Purchaser’s use of the same shall be in strict adherence with applicable laws and in accordance with guidelines/ stipulations issued from time to time by the Government or manufacturer of the Eligible Product.
    • The Eligible Product shall be used by the Purchaser on an ‘as is’ basis and shall not be tampered with, including but not limited to, by way of rooting attempts, reverse engineering, unlocking or jail-breaking of the Eligible Product or original firmware(s) or software(s) of the Eligible Product.
    • To enroll for the Buyback Offer, the Purchaser will have to download the MyJio App on his /her Eligible Product and follow the steps specified in the MyJio App.
    • During Redemption Period, RRL will offer to the Eligible Customers Buyback Value on the Redemption of an Eligible Product, in the form of RRL voucher equal to the Buyback Value, redeemable at Reliance Digital only (hereinafter referred to as “Buyback Offer”) on receipt of the Eligible Product provided in Clause 5 herein below.
    • The Eligible Customer, will be entitled to avail the Buyback Offer during the Redemption Period provided (a) Eligible Customer surrenders the Eligible Product in virus free and in working condition without any Locking or Damage (to further clarify, RRL would not be liable for buyback of any iCloud/Apple ID locked phones, physically or functionally damaged, etc., normal wear & tear excluded), along with its Original bill and box and all the accessories supplied at the time of purchase of the Eligible Product, to Reliance Digital, during Redemption Period, along with eligibility certificate issued by Reliance Digital in this regard; (b) any data or other information of the Eligible Customer on the Eligible Product is deleted before returning the Eligible Product; (c) the Eligible Customer complies with any other terms and conditions as may be stipulated (available at www.jio.com and such other partner sites as RRL may determine) by RRL for return of the Eligible Product; and (d) the Eligible Customer removes the SIM card from the Eligible Product before returning the same. Returning the Eligible Product does not cancel the Eligible Customer’s service contract with RJIO.
    • The Eligible Customer agrees and understands that RRL will expunge all the data including personal information of the customer and restore it to the factory settings and therefore no claims will be maintainable against RRL for retrieval of Data.
    • RRL shall not be liable in any manner to a Purchaser if the Purchaser does not qualify as an ‘Eligible Customer’ at the time of Redemption or the provisions of Clause 5 above are not met by the Eligible Customer at the time of Redemption.
    • The RRL voucher issued on Redemption of Eligible Product may be redeemed at Reliance Digital only.
    • RRL voucher will be valid for a period of 3 months from the date of its issue.
    • Buyback Offer will be available at no additional cost to the Eligible Customer.
    • For the purpose of Buyback Offer, the Eligible Product shall mean the Eligible Products which are identified through the IMEI provided by Apple to RRL for Buyback Offer.
  • Terms and Conditions of the Offer (“T&C”)
    • The Offer shall be open to all Eligible Customers who purchase the Eligible Product during the Offer Period commencing from September 29th, 2017 and ending on December 31st, 2017.
    • Two or more offers cannot be clubbed together. This Offer cannot be used in conjunction with any other alternative offer or promotion of a similar nature in relation to Eligible Product.
    • The Eligible Customer must be 18 years or above.
    • If there is any change in the identity of the Purchaser or change in the RJIO subscriber number used with the Eligible Product, RRL reserves the right to discontinue the Offer Benefits on that unit of the Eligible Product. The Offer will also be invalid if any criteria, applicable to the Eligible Customer, is not met by the Purchaser at the time of Redemption.
    • RRL recognizes that the choice to be contacted by RRL / RJIO or its group companies for promotional messages and alerts is that of the Purchaser / Eligible Customer. RRL / RJIO and its group companies intends to keep the Purchaser / Eligible Customer informed on matters relating to the Offer and any upcoming offers from RRL / RJIO and its group companies for the benefit of the Purchaser / Eligible Customer. Accordingly, by purchasing the Eligible Product and/or availing the Offer, the Purchaser / Eligible Customer hereby consents to be contacted by RRL / RJIO and its group companies and such consent shall remain unaffected by the Purchaser’s / Eligible Customer’s registration in the National Do Not Call (“NDNC”) registry under the relevant category stipulated therefor.
    • RRL reserves the right to cancel/withdraw this Offer at any time, without any prior intimation to the Purchaser / Eligible Customer. However, the benefits accrued to the Purchaser / Eligible Customer prior to the cancellation/withdrawal of this Offer, shall not undergo any change.
    • RRL, may, at its discretion, modify any of the terms and/or conditions and/or any aspect of the Offer, without any prior intimation to the Purchaser / Eligible Customer. The modifications so carried out will be posted on jio.com, and shall be applicable to all Purchasers / Eligible Customers.
    • If any term/ condition under the T&C of the Offer is found to be invalid, void, or for any reason unenforceable, such term/ condition shall be severed from the other terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions of the Offer.
    • Any warranty on the Eligible Product is offered by the manufacturer of the Eligible Product and not by RRL or its affiliates. Any claims, issues, damages or losses with respect to the Eligible Product shall be the sole responsibility and liability of the manufacturer of the Eligible Product, and RRL (including its affiliates, group companies or parent company) hereby disclaims, any and all claims, losses and liabilities, whether or not arising out of, or in connection therewith and/ or this Offer and the terms and conditions governing the Offer. This disclaimer shall apply to the fullest extent permitted by law and shall survive cancellation/termination/determination of this Offer.
    • RRL shall not be responsible for any loss, injury or any other liability of the Eligible Products.
    • By making this Offer, RRL has no responsibility for the actual provision of telecommunication services and the Purchaser / Eligible Customer is solely responsible for availing these services from RJIO.
    • Nothing contained herein shall be construed as creating any arrangement for transfer of title, ownership or interest including rights of any intellectual property in/of the Eligible Product in favour of the Purchaser / Eligible Customer. However, the Purchaser shall own and have free title of the Eligible Product subject to the manufacturer conditions as mentioned in the Eligible Product.
    • In no event shall RRL, it affiliates, group companies or parent company or their respective directors, officers, employees, agents or other representatives be responsible or liable to the Purchaser / Eligible Customer or any third parties for any direct, indirect, special, incidental, consequential, or punitive damages, or exemplary loss, or any other damages of any kind, however, arising out of or related to the Offer, including loss of data, if any.
    • The Purchaser / Eligible Customer hereby authorizes RRL to collect his/her personal information including name, address and mobile number etc. and share with its partners so as to enable the Purchaser / Eligible Customer to avail the Offer. The Purchaser / Eligible Customer’s personal information will be stored and processed in accordance with the Privacy Policy which is available at www.jio.com.

    • All disputes shall be governed under the laws of India and are subject to the jurisdiction of the Courts of Mumbai only.
